• Attempt to gain unauthorized access to any portion of the website, server, or connected systems
• Use the website to transmit malicious code, spam, or harmful content
• Interfere with or disrupt the website or servers connected to it

• Impersonate any person or entity or misrepresent your affiliation
• Use the AI chat assistant to generate harmful, illegal, or misleading content

4. AI Chat Assistant

Our website features an AI-powered chat assistant. By using this feature, you acknowledge that:

• Responses are generated by artificial intelligence and may not always be accurate or complete
• The chat assistant provides general information and does not constitute professional advice
• BTS is not liable for decisions made based on AI-generated responses

5. Intellectual Property

All content on the Backcountry Tech Solutions website — including text, graphics, logos, images, code, and design — is the property of Backcountry Tech Solutions or its content suppliers and is protected by intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from our content without our prior written consent. Client project work product is governed by individual client agreements.

6. Client Projects & Agreements

Engagement for client services is governed by separate project agreements. These Terms of Service apply to website usage and do not supersede or modify any signed client agreement. Key points regarding client engagements:

• Project scope, deliverables, and timelines are defined in individual agreements
• Hosting and infrastructure fees are billed as described in each project agreement
• Source code ownership and licensing terms are specified per-project
• Both parties may terminate engagements according to the terms of their specific agreement

7. Payment Terms

For clients with active service agreements:

• Hosting and infrastructure fees are settled quarterly at solstices and equinoxes
• Project development fees are billed according to the terms of each project agreement
• Late payments may result in service suspension after written notice
• All fees are in US Dollars unless otherwise specified in the project agreement

8. Limitation of Liability

To the fullest extent permitted by law, Backcountry Tech Solutions and its owner shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunity, arising out of or relating to your use of our website or services. Our total liability for any claim arising from these terms shall not exceed the amount you have paid to BTS in the twelve (12) months preceding the claim.

9. Disclaimer of Warranties

Our website and services are provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the website will be uninterrupted, error-free, or free of viruses or other harmful components.

You agree to indemnify, defend, and hold harmless Backcountry Tech Solutions and Erick Tronboll from and against any and all claims, liabilities, damages, losses, and expenses (including reasonable attorney's fees) arising out of or in connection with your use of our website or any violation of these terms.
